Difficult witnesses can challenge even the most experienced deposing counsel, and the authors provide numerous suggestions on how to deal with scenarios involving difficult witnesses. The authors emphasize the technique of using cross-examination constructively, to elicit facts from opposing witnesses to further your own theory of the case, as opposed to merely attacking your opponent’s theory of the case. This technique, first introduced by Larry Pozner and co-author Roger Dodd in the classic work Cross-Examination: Science and Techniques, is devastatingly effective. Numerous examples of deposition testimony are woven throughout the chapters. These examples clearly illustrate the points made in the book.

Roger J. Dodd

ROGER J. DODD has active law offices in Park City, Utah (Doddlaw), Valdosta, Georgia (Dodd and Burnham), and Jacksonville, Florida (Spohrer and Dodd) where he practices trial work of all types. This includes personal injury, wrongful death, criminal defense, and the rare domestic relation case. He is listed in Best Lawyers for more than 20 years. He divides his time now by trying cases other lawyers are unwilling to try in far flung jurisdictions, teaching small groups of eight lawyers at a time in a clinic setting with professional improv actors playing the witnesses (www.doddlawclinic.com), and coaching individual lawyers in individual cases. Teaching/coaching individuals has become an extremely satisfying addition to his practice. He has published multiple books.
